TERMS & CONDITIONS
Delivery:
We aim to despatch your order as soon as possible, normally by the next working
day. UK customers should receive their orders, on average, within 2-4 days of
dispatch. Royal Mail states they’ll deliver within 10 days but the vast majority
of cases are much quicker than that. European customers generally receive their
orders within 15 working days and Rest of the World customers within a month.

In the event of any ordered items not being in stock,
Cancellation:
The Company extends the safeguards of the UK Consumer Protection (Distance
Selling) Regulations 2000 to all customers worldwide. This guarantees a 7 day
right of cancellation and full refund of payment, provided any products supplied
within that time are returned in original condition at the customer's expense.
Save as required by these regulations, or pursuant to clause 6 above however,
the contract will be non-cancellable by the Customer, once confirmed by the
Company. Ordering mistakes by Customers with regard to products, quantity or
specification especially for custom manufactured or painted products will not
constitute grounds for cancellation. Notwithstanding, acceptance of cancellation
by the Company in exceptional circumstances and any refund or part refund will
be solely at the discretion of the Company.
Customs Charges:
Please note we are not responsible for any Customs Charges outside of the EU.
Credit Card Security:
We accept all major credit and debit cards through Paypal. All card transactions
are verified by Paypal – the world’s most popular merchant gateway.
Guarantee:
We guarantee all products to be of merchantable quality, and as advertised. If
you feel otherwise, please contact us for an immediate refund. We further
guarantee that you may cancel your order by email right up until the point your
order is shipped. Please also refer to our Returns Policy below.

Privacy Policy:
Battle Colours do not disclose buyers’ information to third parties and remain
in our database for contact details of orders, quotes, email correspondence
specific between us and the customer.
Returns Policy:
Battle Colours comply with the ‘Distance Selling Regulations’. A customer has
the right to cancel their order without giving a reason. A customer may return
any item within 7 working days of receipt for a full refund less ‘shipping
costs’. Missing items, damaged goods or any other disputes should be reported
either by email or by post within 7 working days of receipt. The items may be
returned for a full refund (including postage) or replacement. Battle Colours
will make every effort to replace damaged goods but if replacement is not
possible, or if an order is cancelled for any other reason, Battle Colours’ only
obligation shall be to refund the full purchase price of the painting price.
Any costs of miniatures ordered specifically for a commission are not included
in a refund. This will be deducted from the refund.
The customer is responsible for the costs incurred in returning any items,
except in cases of faulty, damaged or wrongly supplied goods. A deduction shall
be made from the refund of any direct cost of collecting the goods. The goods
must be returned in the condition that they were first supplied. Email us
straight away if there are problems with your order. When we confirm to you that
return is possible, please include a covering letter explaining the reason for
the goods being returned and your full name and address. The customer will be
refunded as soon as possible.
Remittance Terms:
Payment can be made online using Credit Card, Debit Card via Paypal or Paypal
itself. You may also pay by UK cheque or Postal Order, but these must clear
before work starts on your order (usually allow an extra 7 days). Contact us in
the first instance if paying by UK Cheque or Postal Order.
Conditions of Contract:
No contract will subsist between you The Customer and The Company for the sale
of product(s) or service(s) to you, unless and until The Company accepts and
confirms your order in writing or by email. The contract when formed will be
deemed to have been concluded in Scotland and will be interpreted, construed and
enforced in all respects in accordance with the laws of Scotland, and will be
subject to the jurisdiction of the Scottish Courts. In the event that any clause
within these terms is deemed at law to be unreasonable or unenforceable such
clause will be deleted and such deletion will have no bearing on the validity or
interpretation of the remaining clauses.
Warranty:
The Company warrants that all products and services supplied will be of suitable
quality and fit for their designed purpose, and offers an unequivocal guarantee
that they will be free from manufacturing defect or fault. Exceptionally
however, any discounted or sale products will be sold as is and are specifically
excluded from this guarantee. No guarantee is offered where products are used
for purposes other than that for which they were designed. This warranty is in
addition to, and does not affect, your statutory rights.
Title and Risk:
Title in the goods will pass to the Customer on payment of the full order price.
Risk however, will be carried by the Company until such time as the products are
delivered to the Customer.
Force Majeure:
In the event of circumstances outside the Company's control affecting the
performance of the contract, the Company will be entitled to notify the Customer
and revise or cancel the contract to reflect the changed circumstances and the
Customer will accept such changes.
